However, it is a condition that the au pair attends at least 10 hours of language course per week during the stay. Furthermore, the income and earnings of the child may not exceed 7,680 euro per year. According to the German institute of business journalism (Institut für Wirtschaftspublizistik) in Würzburg (file number: VIII R 8/04), this is what the federal finance court (Bundesfinanzhof) of Munich has decided. The benefits which a host family grants to the au pair - e.g. free board and lodge - also come under income and earnings. Therefore so-called values of benefits in kind have to be assessed - for 2004 it was 191.65 euros per month for free lodge and 197.75 euros per month for free board.
